Bribery in the Third Degree
A "D" felony punishable by up to seven years in state prison, Bribery in the Third Degree (New York Penal Law 200.00) is the lowest degree or level of Bribery in New York State. While each county may have different standards or guidelines when prosecuting New York Bribery crimes, whether you are charged in Manhattan, Brooklyn, Queens, Westchester or any other jurisdiction, the offense is the same.
You are guilty of Bribery in the Third Degree (NY PL 200.00) if you merely offer or agree to confer any benefit upon a public servant. In exchange there is an agreement or understanding that that as a result of the benefit you give to this public servant, his or her decisions, actions, vote or judgment will be influenced.
It is critically important to note that as with all crimes relating to Bribery, the benefit offered or given to the public official need not be money. The benefit could come in the form of cash, but could also be vacations or any type of property from cigars and watches to leather goods and tickets to sporting events.
