Bribery in the Second Degree
A "C" felony punishable by up to 15 years in prison, Bribery in the Second Degree (NY PL 200.03) is the "mid-level" Bribery crime in New York. Like Bribery in the Third Degree (NY PL 200.03), it makes no difference whether the crime was committed in New York City in Manhattan or Westchester County in White Plains. The critical components or elements of this crime are that you confer or merely offer a benefit to a public servant with the understanding that his or her decisions or actions will be influenced by your offer. This crime is bumped up from the Third Degree to the Second Degree when the offered benefit given to the public official is valued in excess of $10,000.00. Again, just like Bribery in the Third Degree, the benefit offered need not be cash or money.
