Bribery in the First Degree
The most serious of all crimes relating to Bribery in New York, Bribery in the First Degree, pursuant to New York Penal Law 200.04), is a "B" felony. Not only is there a mandatory term of incarceration required if you are convicted, but the maximum sentence is twenty-five years.
Much like both Bribery in the Third Degree (NY PL 200.00) and Bribery in the Second Degree (NY PL 200.03), Bribery in the First Degree occurs in the same way. You are guilty of this crime if you offer a benefit or actually confer a benefit to a public servant with the understanding that his or her decision making process or particular course of action will be influenced by the benefit. The critical difference in this First Degree crime is that the benefit must influence an investigation, arrest, detention, prosecution or incarceration as to an individual who has allegedly committed an "A" felony. They value of the benefit is irrelevant for this offense as well as the form (cash, jewelry, a cruise, etc.) of the benefit.
