Drinking Driver Program: DDP

Although it is often a condition of any plea, prosecutors are not required to ensure that you take the Drinking Driver Program ("DDP"). Having said that, the DMV will require that you participate in this program if you wish to receive a conditional license to drive in New York State. The fee for the DDP should not exceed $300, but this can be confirmed with the DMV as costs and fees routinely change.

For most people, the DDP is merely classroom based. Over the course of seven weekly classroom sessions (two to three hours each), you will learn about your arrest for DWI and the ramifications - legal, medical and social - of the crime. If a counselor or director determines you need more "help," the staff does have the authority to direct you to receive formal substance abuse screening. After evaluation, you may be mandated to formal substance abuse treatment. If you fail to complete the initial evaluation or subsequent treatment, your conditional license will be revoked and you will be removed from the DDP. Should you complete the program, whether you were required to receive additional treatment or you only had to attend the classroom sessions, you will receive a "Notice of Completion."

DDP Completion and Re-Licensing

If your license was previously suspended, as opposed to revoked, in addition to DDP completion you must pay a suspension termination fee as well as other potential license renewal fees. You must also go to any New York State DMV office for this license restoration. If your license had been revoked, you must not only complete the DDP and bring the Notice of Completion, but you must also bring your conditional license to the DMV office that initially issued your license. Just like a suspension, you must pay the fees required by the DMV. It is critically important to understand that even if you complete this, the DMV is not required to automatically give you back your license.
